These Terms and Conditions (“Terms”) govern access to and use of the Humanly.app website, software, application programming interfaces, and related services (together, the “Services”), operated by Humanly Project Ltd (“Humanly”, “we”, “us”, “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. About Humanly

Humanly provides software tools that analyse digital content, including images and documents, to assess indicators of authenticity, manipulation, editing or AI generation. The Services support decision making but do not provide legal, medical, financial or regulatory advice.

Humanly does not determine truth, intent, liability or outcome. All decisions remain the responsibility of the user.

2. Eligibility and Account Registration

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services.

You are responsible for:

  • maintaining the confidentiality of your account credentials
  • all activity carried out under your account
  • ensuring information you provide is accurate and current

You must notify us immediately of any unauthorised access or security breach.

3. Acceptable Use

You agree not to use the Services to:

  • violate any applicable law or regulation
  • infringe intellectual property or privacy rights
  • submit content you do not have the right to process
  • reverse engineer, interfere with or disrupt the Services
  • use the Services for surveillance, profiling or harm to individuals without lawful basis

Humanly reserves the right to suspend or terminate access where misuse or abuse is reasonably suspected.

4. Content Submitted to the Services

You retain ownership of all content you submit (“User Content”).

By submitting content, you grant Humanly a limited, non-exclusive, royalty-free licence to process the content solely for the purpose of providing the Services.

You confirm that:

  • you have the legal right to submit and analyse the content
  • processing the content complies with applicable data protection laws

Unless otherwise stated, Humanly does not use User Content to train general purpose AI models.

5. Nature and Limitations of the Services

The Services provide probabilistic analysis, not certainty.

Results:

  • are informational and indicative only
  • may contain false positives or false negatives
  • must not be relied upon as sole evidence for enforcement, legal action or medical decisions

Humanly does not guarantee accuracy, completeness or suitability for any specific purpose.

You acknowledge that:

  • AI detection is an evolving field
  • adversarial techniques may reduce effectiveness over time
  • no detection system is infallible

6. Sector-Specific Use Disclaimer

Humanly may be used in contexts including insurance, identity, healthcare, retail, property, government or personal protection. However:

  • Humanly is not a regulated service
  • Humanly does not replace professional judgement, audits or compliance frameworks
  • users remain responsible for sector-specific regulatory obligations

7. Fees, Subscriptions and Billing

Certain Services require payment.

Pricing, usage limits and features are described on the Humanly.app website or order form.

Subscriptions may include:

  • recurring monthly or annual fees
  • usage allowances
  • pay-as-you-go usage
  • optional top ups or auto-top up features

All fees are exclusive of VAT unless stated otherwise.

8. Stripe Payments and Auto Charges

Humanly uses Stripe as its payment processor.

By providing payment details, you authorise Humanly and Stripe to:

  • charge subscription fees
  • charge usage exceeding included allowances
  • process automatic top ups or auto charges where enabled

Auto Charges and Auto Top Ups

If enabled, you authorise Humanly to:

  • automatically charge your payment method when usage exceeds allowance
  • apply additional credits or usage without further notice

You are responsible for monitoring usage.

Failure of payment may result in:

  • suspension of Services
  • loss of unused credits
  • termination of your account

9. Credits and Usage

Credits:

  • have no cash value
  • are non-refundable unless required by law
  • may expire if specified at purchase
  • are consumed according to usage rules in effect at the time

Unused credits do not roll over unless expressly stated.

Humanly may adjust usage logic or pricing with prior notice.

10. Free Trials and Promotions

Free trials or promotional access:

  • may be withdrawn at any time
  • may include limited functionality
  • must not be abused or repeatedly accessed through multiple accounts

11. Intellectual Property

All Humanly software, models, branding, documentation and materials are the exclusive property of Humanly or its licensors.

Nothing in these Terms grants you ownership or licence beyond the right to use the Services in accordance with these Terms.

12. Confidentiality

Each party agrees to keep confidential any non-public information disclosed in connection with the Services, except where disclosure is required by law.

13. Data Protection

Humanly processes personal data in accordance with applicable UK GDPR and data protection laws.

Details of data handling are set out in the Humanly Privacy Policy.

You are responsible for ensuring lawful basis for any personal data you submit.

14. Suspension and Termination

Humanly may suspend or terminate access:

  • for breach of these Terms
  • for non-payment
  • where required by law
  • to protect system integrity or other users

You may terminate your account at any time. Fees already paid are non-refundable unless required by law.

15. Disclaimers

The Services are provided “as is” and “as available”.

To the fullest extent permitted by law, Humanly disclaims all warranties, express or implied, including fitness for purpose and non-infringement.

16. Limitation of Liability

To the maximum extent permitted by law:

  • Humanly shall not be liable for indirect, consequential or economic loss
  • total liability shall not exceed the fees paid by you in the twelve months preceding the claim

Nothing in these Terms limits liability for death, personal injury or fraud.

17. Indemnity

You agree to indemnify Humanly against claims arising from:

  • your misuse of the Services
  • unlawful content submission
  • breach of these Terms

18. Changes to the Services or Terms

Humanly may modify the Services or these Terms from time to time.

Material changes will be notified via the website or email.

Continued use constitutes acceptance of updated Terms.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction.
